Be careful when doing a short sale OWNER OCCUPIED only

 California Code Civil Procedure Section 580(b). applies to purchase money loans and purchase money loans on residential 1-4 units owner-occupied.
The code states:
"No deficiency judgment shall lie in any event after a sale of real property or an estate for years therein for failure of the purchaser to complete his or her contract of sale, or under a deed of trust or mortgage given to the vendor to secure payment of the balance of the purchase price of that real property or estate for years therein, or under a deed of trust or mortgage on a dwelling for not more than four families given to a lender to secure repayment of a loan which was in fact used to pay all or part of the purchase price of that dwelling occupied, entirely or in part, by the purchaser."
Applies to two types of loans:
1. purchase money loans and
2. seller carry back loans.
Seller carry back loans are not entitled to seek a deficiency judgment against the borrower.† However, there are exceptions under California (case law) that does permit the seller to recover against the borrower under certain circumstances.
As for the purchase money loans - no deficiency if it is owner-occupied, residential one to four.†
What does that exclude? vacation homes,
home-equity lines of credit (HELOC),
investment properties where the borrower does not reside there, apartment buildings more than 4 units.
These loans are commonly referred to as "non-recourse" loans because lenders on these types of loan know their only recourse is the property.

I love Chronic Tacos. The ingredients are fresh. I like to watch them cook right in front of me. Their burritos are so fat you can’t hold them without five napkins. They ought to change the name of the burrito to the football, because it’s just about that size. Most Mexican food can’t be considered healthy but if you pick the right items Chronic offers a menu that is even good on a diet. Just avoid the chimicanga, fried items and chips and you can go home guilt free.

The line moves quickly and you tell them just how you want it and they will even offer free advice on their grilled mahi mahi.I don’t eat beef and pork but my son swears by their carne asada as grilled tender cuts of beef with plenty of flavor. IF you are watching your weight – get a tostada without the shell, go light on rice and beans (not refried) and pile on the veggies (light on the avocado – I believe avocado makes just about everything in the universe right. —you need a little good fats in your diet so just a little guacamole). The pico de gallo (tomatoes, onions, garlic and lime is made in batches during the day

The prices are reasonable. A burrito ranges from $ 4.75- $ 6.79 depending on the meat or fish you choose, just right for your budget.

Their menu says they have 27 locations but the best is in Dana Point, but the Corona Del Mar one is just as friendly. They also have a location in Newport, Huntington Beach, and Two in Mission Viejo and surely somewhere near you. If you are in a splurge mood go crazy and get pork tamale and a beer and sit outside on the casual tables and chat with the locals. They say they are franchising everywhere. I hope they keep a tight reign on franchisees because the secret is consistency.

 There used to be a wine bar next door but it a sign states a pancake place is coming. P. C. H. seems like a funny location for breakfast place to survive

Shea why take away something so good?

   I love getting up early and after my run going to I Love Bagels. I purchase six hot bagels and the full fat cream cheese then sit outside on the tables with my coffee black. I am certain to see parents from Laguna Niguel Little League with cheerful faces. I chat with sleepy Dana Hills teenage girls still in their jammies in line hustling in to pick up a toasted everything bagel or neighbors with their dogs tied to the chairs of the outdoor dining patio. It’s not a luxury patio with an ocean view; it is a homey community location.
   I Love Bagels was told when their lease was expiring that Shea Properties would not negotiate a new lease. It doesn’t make sense. Retail space is very available in the Village, Town Center, the Plaza, the Clubhouse and other similar locations in Laguna Niguel for $22- $33 a foot. Our economy is not booming to turn away a paying tenant.  I Love Bagels is an excellent compliment to the center because it is used in the mornings when the other restaurants and theater are closed. I Love Bagels is not a ‘major” or publicly traded brand like Bed Bath and Beyond, Pier One, Trader Joe’s or 24 Hour Fitness which also occupy the center; but I always window shop at Pier One on my Saturday morning I Love Bagels run.
   The only conflict might be that Peet’s coffee (highly upgraded inside tenant improvements compared to the spare plastic benches of I Love Bagels) sells coffee and baked goods. Peets’ coffee might be superior but it attracts an older crowd. I would rather support an independent and local owner. So why is I Love Bagels Ocean Ranch Center is being forced to close its Golden Lantern location by Shea Properties?
    Shea, a privately owned company, you would think is seeing down turn in their own business. John Shea who lives in Pasadena was named the 37th wealthiest person in Los Angeles County last year. He owns 10 million square feet of office space, golf resorts, Reed Construction, a home building division, and apartment and retail space valued at $870,000,000.  Shea properties response was that I Love Bagels closes  at 3:00 and they want a tenant who will be open evenings/ mall hours.  I Love Bagels is moving across the street, they will have some down time. The other store on Crown Valley will remain open. I will miss the community of the patio. I know many other neighbors will feel the same. John Shea, I wish you had been more caring in your decision because I won’t go frequent your other tenants now.

Banking isn't Boring



Syracuse University students greeted banking graduation speaker with a blow up doll today.
Merkley-Levin Amendment summary (as it remains) in the Reform Bill:
1. Bank traders can no longer act like hedge funds.
2. Financial firms will not be able to bet against their own customers.
3. Banks will still be able to securitize loans.
4. Banks will be able to hold clients money but not use bank funds.
   Goldman, JPMorgan, and others will have time to sell off these accounts/
   Divest of accounts they managed with bank dough.
5. Non-banks can gamble, trade, and bet against their own customers, but they must create cash accounts against their speculations.

The Germans no more “nakedshorting”  (gambing of short selling bank stocks without having cash in an account to cover) badly spun the stock market by surprise yesterday.
Germany came out today with approving a huge bailout program for the weak members of the EU, this calmed our stock market fears a little.

So will the banking reform bill be a ping-pong match in the coming weeks?

Trash Burning At Pelican Hill

Under the elegant and posh massive arching gates (created to imitate Roman aqueducts or grand Italianate structures) a fire started inside the belly of the trash pickup. Garbage was strewn all over the street, which was blocked by numerous fire trucks that responded. I’m surprised the event was not reported in the O.C. Register, as the smell could be detected from the top of Newport Coast. The odor of rotting and burned junk- not what Newport Beach real estate needs today…The good part of the morning’s event was seeing those handsome Newport Beach firemen working with great care to douse the smoldering flames. It is assumed someone packed fireplace ashes in their Hefty bags.

Lancaster Community Hospital Kicks a Man who can't move to the Curb

Al Smith is not famous; he is a nice guy who came upon hard times. Al is homeless and went to Lancaster Community Hospital last week when he had weakness in his legs. The hospital performed surgery on Al and they say they removed a cancerous tumor on his spine. Al walked into the hospital and now is a paraplegic. Lancaster Community hospital Director Bob Trautman is unavailable for comment as the hospital plans to kick this man to the curb (who can’t walk, can’t eat, and can’t release his own bowels.)


I know Al because he did some work for me a year ago. Al is a quiet person who would not complain. Hospital personnel told him the have a social worker processing his Medical, but it is not completed for an unknown reason. I asked the hospital receptionist would she treat her dog this way?

No shelter will take him because the amount of care he needs ( he has numerous tubes in and out ) is far beyond their means.

HOME OWNER ASSOCIATION Run just like Peoples Republic?


Home Owner Associations wield sole absolute power over residents. Is the Owner of K. Pacific a parallel to Hu Jintao of China?

     Laguna Niguel was originally planned by developers who turned over the maintenance of landscaping, pools, and a variety of open areas to owner run ‘Associations’.  There is no uniformity or legal sameness in the original written ‘Charters’. The first Home Owner Associations were often run by well meaning residents who were unpaid.  Associations collected large sums of money and faced the whining and complaining of a small few. Early do-gooders moved out of those positions after learning it was far easier to lay low and avoid pettiness. Associations hold elections, which often the majority owners never voted in new officers (in some complexes the process vague or difficult). From this grew a new crowd of Boards, cropped with their own agenda. It is not accidental that the guy whose brother owns the largest landscape contractor in the County or the Construction Roofing/decking Corporation gets the seat on the Board. Some Associations later turned accounting over to professional management companies because of fraud, bad math practices and lawsuits.  There is no legal licensing requirement to run a HOA. Some have completed classes on the legal aspects of HOA’s. There are two California organizations, which provide newsletters and informational support.
   Still today, secret contracts are granted to the buddy in the business in the millions of dollars.  An Association will have rules, CCR’s Budget and Bylaws but each complex will has separate rules, which may or may not be followed. There is no uniform enforcement but by the professional management company who can arbitrarily decide permits and file legal actions without cause. And who foots the legal bills? Answer: every resident in the tract.

   Residents of Mission Hills community are currently outraged by the removal of 328 trees for a cost of nearly fifty thousand of their hard earned dollars. The Management Company and the Association seem unavailable for comment. By the next Board meeting date, the trees will already be cut to the nub. Someone might say Eucalyptus gum trees aren’t native. They are fast growing trees that are a fire hazard, fall hazard and whose leaves and trunks are so toxic that they cannot be burned without a toxic hazard permit. I had a full grown Eucalyptus fall on my car at my office (thanks Koll Company who had 3 felled trees in same lot over seven months- Koll Co. claims to not be responsible for their deferred maintenance. I asked them to post a sign saying the trees are a hazard to life and limb- they did not). Others in the community like the privacy or the sounds of rustling winds through the branches. Still more will complain that now the Board has removed the habitat for possums, coyotes and critters we are seeing more of these now disturbed in the canyon and as road kill.
   So why does only one family want to speak with the Orange County Register when they all are complaining in their front yards?  Is it fear of the big bad Board?  Perhaps the Homeowners go to the next meeting and say, we aren’t paying the unauthorized fifty thousand dollar bill?
  Don’t worry, there will be another lawsuit. Only the lawyers appreciate apartheid life behind the Orange Curtain. Buyers beware before you buy in an HOA.  Condominium Associations in all the sand states are far worse; some have no fire insurance policy for the community building.

Revolutionary Green Home and Office


     Revolutionary Green Ideas for Office and Home aren't that difficult or costly. I’m thinking about oil/ OPEC/Crude spilling in the Gulf and the best answer to being greener today is to cut our consumption by forty percent. I don’t just mean gasoline; I am talking about cutting our electric, gas, trash and water usage.
   My local water company (Moulton Niguel Water in Lguna Niguel) asked residents and businesses to cut water usage by 20% during a severe water shortage. My household cut our water down by thirty eight percent, and I have several teenagers at home. My father used to make us take "military showers", there were so many of us if you didn’t the small house water heater would never have regenerated enough hot water. This sounded crazy to my children who are accustomed to relaxing in the hot shower until the tank runs out. A military shower was defined as, ten second rinse and soap the washcloth; turn off the water and lather and shampoo then 2-minute rinse in hot.  That was unreasonable considering I had established a trend and belief that taking a long shower was somehow a luxury that they deserved.
   I used a kitchen timer with a buzzer, and if they take a shower in less than five minutes they get a dollar. I know a bribe, but it worked and changed their concept of hot water relax. If they want to be leisurely they take a bath in less than 3 inches and sit until they are pruney.
   I installed displacement toilet dams in toilet reservoirs. Placing one or two plastic containers filled with stones (not bricks you will have a rusty colored toilet) in the toilet's reservoir will displace about 4 liters of water per flush. I am not a big supporter of low flow toilets because in California they are required but many users end up flushing multiple times to accomplish the goal. I may not be so prudy and will refrain from the 1980’s slogan about it being yellow.
   I love to garden. The idea of not having spring flowers everywhere was a sacrifice I wasn’t willing to cut. I compromised and mulched more and turned the sprinklers on the grass areas off and only water the flowers and pots. I recycle much water from household use and only use a spray cut off nozzle for any cleaning. Our water bill went down $380 a month, even with the dollar bribes I'm ahead because I'm an ATM machine anyways isn't every parent?
So how do we apply the concept larger? Just don’t buy as much. Don’t buy products with large part only packaging. This saves time, space, and clutter.
   In the office it is more difficult to convince a team to cut back for the good of being “green”.  There are a couple simple tips that can make a business not only save money, save in trash and perhaps benefit the whole.
   When you leave your desk Turn off equipment when it's not being used. This can reduce the energy used by 25 percent; turning off the computers at the end of the day can save an additional 50 percent.
   Communicate by email, and read email messages onscreen most can be saved in folders without the need to print them. Organizing the folders by project can allow you to access information at the keyboard without sorting through junk.
   Reduce fax-related paper waste by using a fax-modem and by using a fax cover sheet only when necessary. Many Fax-modems are free and allow documents to be sent directly from a computer, never requiring a printed hard copy.
   Produce double-sided documents.
   Do not leave taps dripping; always turn off tightly. (One drop wasted per second wastes 10,000 liters per year.)
   Be a hero. Don’t make a pot of coffee only for you, be friendly and generous and ask if others want a cup.
Being green does not require huge time or cash, just awareness that we are all responsible.

Recent Single Family Sales Improving

Sales in Orange County that are less than 4 miles from the water are recovering. Residential real estate inland is not improving. See attached numbers this past March compared to last year. Single family homes in Newport, Laguna, Dana Point with a water view are selling.
Condominiums are still being hit hard county wide.

How much human hair will it take to absorb all the oil BP is going to put in the gulf?
Even if we all shave our heads and shove it in nylons will it be enough to absorb?
Where is there a toxic waste dump near or large enough to hold in a concrete pool where

I live on the border of Laguna Niguel and Laguna Beach. When I look at the Megan's law website maintained by the state of California I see 12 persons registered in Laguna Niguel and 16 in Laguna Beach. (one is missing i.e: no photograph and no known address since 1989)

The serious error is this: the City of Laguna Beach police department is monitoring 33 registrants, a few of whom are homeless, and three are off the radar. While the City of Laguna Niguel does not have it's own police department the Orange County Sheriff is monitoring 19 persons for Laguna Niguel. In my own neighborhood two registrants appear to be living too close to an elementary school.

The system we have is not very accurate. Human beings can move about you can see that today there must be tighter control of the location of these dangerous predators. They gave up their right to go to a public park or show up at an elementary school when they did the crime.

Bill 1844 proposes:



Life imprisonment without the possibility of parole for forcible sex crimes against children under 18 when aggravating circumstances exist. The type of aggravating circumstances that would require the harshest sentence depends on the age of the victim. Some aggravating circumstances include physical harm, kidnapping, torture and use of a weapon.

• Where no aggravating circumstances exist, penalties would double for certain sex crimes, depending on the age of the victim. For example, the new prison sentence would range from 6 to 16 years for forcible sex crimes against children under 14.

• Registered sex offenders would be subject to misdemeanor charges and possible parole revocation if found in a park where children regularly gather — unless prior permission had been granted by the park administrator or parole agent.

• Parole terms would be doubled to 10 years for a forcible sex crime, regardless of the age of the victim.

• Those convicted of a sex crime against a child under 14 would be on lifetime parole, requiring constant supervision and a global positioning system tracker.

Fix Your FICO free

A high FICO score can secure a good loan, a great job, or standard rate insurance. The Privacy Act is supposed to help us keep our information quiet, but your score is available to many more than you know. Did you know mailing lists may be compiled by your score?

FICO score is a computer analysis of the following items: Payment history 35%, Amounts owed 30%, Length Time of Credit History 15%, Types of Credit in Use 10%, and New Credit 10%. Lowest number score is 300 and highest is 850. You don’t need to know who invented the computer model or who owns Fair Isaac (call me if you do). There also are Vantage Score, Trans Risk, and Score X, (branded models not yet used much by Lenders).

To improve your score get a full merged report with all three reports,” Credit Cops": Equifax, Experian and Trans Union. Each of these companies may report your information differently, and therefore you will have three scores. You are entitled to free credit report once a year from: annualcreditreport.com however you are not entitled to Free scores. Do not go to Free credit report.com or any scam company that loops you into billing monthly and fails to release the monthly credit card bill. Trans Union, Equifax and Experiam offer websites direct as well. They do not advertise on television, they do not need to.

Review trade items on each report. Derogatory items are at the top of the report. The name of creditor and account number (often shy four digits for security) show for each. Below the account name is available line and payment history. The history also may show as a time line calendar below in reverse order as line ticks.

If anything is incorrect, you begin your letter writing campaign. Write; do not call, to each individual creditor. In the letter include: Your name, home address, the account number, today's date, the reason why you dispute what shows and sign the letter. Be simple for example: Dear Bank of America: I never was late on 4/2009 here's a copy of my cancelled check...The letter does not have to be perfect- it has to be done and in the mail. Do not include your telephone number you want a written response.

Make a folder with a time line on the front. Day one sent letter asked for response in ten days. If they fail to answer in thirty days you are going to write and mail follow up letters. Include in the letter that you wrote them asking to correct the inaccurate item on x date and they failed to respond in thirty days. Also include that they are required by the Fair Credit Reporting Act to investigate and they failed to do so. You may also state you intend to file a complaint with the FTC. You want them to send you a letter deleting the item and to correct the information they report to all credit companies. Once you have the letter deleting the item forward to Equifax PO BOX 740241 Atlanta GA 30374-1111, EXPERIAN PO BOX 2104 Allen TX 75013, TRANS UNION PO BOX 390 Springfield PA 19064.

Tips on raising your score:

Pay everyone on time. Get delinquent accounts current now first and pay the minimum on the remaining accounts. Keep revolving balances 68.9% below the available line. Do not use Finance Companies. Do not open accounts with furniture/ mattress/computer stores that promise 90 days no payment as is sold to a finance company. These types of accounts lower your score. If you have finance accounts pay it off.

Do not allow car dealers to shop a loan for you and add needless inquiries to your score. Don’t sit there and hand them your driver’s license, bring a copy of the license and say I am not required to give you m social security number to test drive a car. Do not close accounts - just pay them off. Do not use disreputable Consumer Credit Counseling companies- they often allow late payments to roll and interest and balances to grow. Do not fall prey to anyone who claims you can buy a new social security number. Do not pay huge fees to credit repair companies who won't work as hard as you can on your own letter writing campaign. Anything that sounds too good to be true like “we can erase $10000 of your credit card debt with the new Obama bill” is too good to be true. Negotiate with all collection companies to delete the disputed item in exchange for paying part or all of it.

Opt out of all junk mailing lists. Be ever so careful entering your private information on any website. Do not use matching passwords with easy to guess tags. The internet is a wonderful place but not everyone on there is who they say they are.

Goldman Employees Donate Houses in the Hamptons

Cyrus Sanati writes today about the Senate considering Jail time for Goldman Sachs employees.

In watching the Senate hearings, I believe Senators did not ask the right questions.They failed to deeply understand the nature of the business. Banking/finance/and secondary has anachronisms that perhaps hide from general public language to abbreviate models. I should have mailed some cue cards to Arlen Specter.

If a law is passed that a broker dealer has to disclose all trading positions (short or long) would it stop an investor from touching what they believe is gold? Maybe not.

If the accounting is rigged or there is fraud, then yes punishment is in order.
Does jail time deter anyone? Violent crimes occur in death penalty states.

These high achieving personalities are about success measured in dollars. Huge financial penalties might be a bigger deterrent. Make the fines usurious, bankruptcy remote and put them on the chain gang?
I'm not Mike Whitney and I love Prada shoes, so I hope the reform is orderly.

BP what about the men that Died?

Tony nice press release but a few things already don't add up. Oil business is dangerous work. Little has been mentioned about the men who perished on the rig. Little has been released about why the line has so
many deferred maintenance cracks and holes. Some of your command center decisions lack leadership.

I don't know it you have children, but allow me to share a story. When mine were younger we used an imaginary person to blame when things went missing, or tops of flowers were batted off with a lacrosse stick .I would put the guilt on "Alfredo Sauce". I blamed a naughty "Alfredo" for eating all the oatmeal cookies again, and they would laugh. "Alfredo" has been a running joke of not owning up, of failing to fully raise your hand and say "Forgive me, I will fix it."

My children like that white cream cheese sauce, but it's really not good for anyone.  In my mind it's indirectly linked today to the oil slick - the deadly murk of poison cholesterol coming to our Gulf shores.

Fifteen men died on the Texas rig, I know that's in the past but this time do us a favor, accept the big mistake. Tony Hayward are at the helm of the ship, you are a scientist, you measured the risks verses the profits and failed to investigate before leasing an unsafe situation.

Please don't rely on America to foot the bill for your error we don't want to nickname you Alfredo Sauce.
Get the British fleet over here and get on it man. Say something inspiring to rally volunteers on the Gulf shores, there must be some better solutions than spraying chemicals on the surface of choppy surf and booms like paper boats. Don't we have some science to cap the source?

Chemical dispersants sprayed on the surface by helicopter are supposed to break the oil 5000 feet down? That makes as much sense as using a can of spray paint to stop a hurricane.
US Coast Guard Petty Officer B. B.confirms they are using Corexit manufactured by Nalco. They are also testing another chemical (unknown name)
Corexit is dispersed by sprayer in100% solution. It is like a heavy detergent that changes the oil to heavier droplets, which will fall to the bottom of the sea floor.
It also counters or breaks up the mousse like oil foam at the shore. Chemicals like this were used in the Exxon Valdez spill. Active ingredient butoxethanol is used as a solvent in oil paint. It can cause headaches, vomiting and reproductive problems at high doses.

So to summarize my view of BP’s plan:
Add toxic chemicals to make the oil sink and be out of minds of America.


So when the oil and poisons sink to the bottom, everything on the bottom carries poison.
Good thing I can't eat shellfish, but what about the rest of the food chain?

Short Sale Checklist

SHORT SALE Flags

Taking a listing on a short sale is not a simple transaction. To start, make list of the layers of people you will need to work with. A number of the parties in the transaction are under stress. A calm voice and organization is your mantra.
The seller of the house is doing so because they have to. The seller may have time constraints and personal issues, more than what I call the four D’s –(death divorce and disaster). Often the seller may be unemployed or out of work as are so many Americans today. Being in the same boat does not make it any easier. A come to Jesus talk from the start is useful and you will need a yellow note pad and likely tissues.
The Lender or Lenders as there may be a first second and third are often not the same company, and even if they are the loans may have been originated by companies/banks they have acquired by not so smooth transitions. The bank employees in loss mitigation departments have piles of files and are working long hours. The bank itself does not realize any profit from completing the transaction (but a minor $1500- $1000). The Underwriting, processing appraisal, legal and operations review staff may invest a total cost of $ 40000 of labor and paperwork.

The subject property is likely to have deferred maintenance which you need to accurately review. The seller has no money to strap the water heater, provide termite clearance costs or purchase and repair things that may be health and safety hazards, which are impossible to overcome if the offer is a government loan contingency.

Next you will have the Property tax Collector/ Assessor who probably has not been paid. Taxes don't get waived. Most counties have local websites to view what penalties and balance is owed, and the owner should have a recent bill.

Then also consider and uncover the existing Fire Insurance coverage. You need an adequate review in advance as a distressed seller may have multiple claims which increases the cost of insurance on the subject (assumption being repairs may have not been completed). Also in the mix may be the Home Owner Association. In California H.O.A.’s are managed by separate management companies (who also have been unpaid).

Neighbors may also be a negative or positive influence upon the listing. This may have been caused by the Seller lacking financial ability to maintain the property. You should be able to convince the neighbors that a new equity owner in the neighborhood's best interest as they will "fix up" the house.

Upfront you need to be organized. The Seller will need to provide 2 months bank statements (of all assets), paystubs for a month, w-2 forms and tax returns. The Seller will need to write an explanation letter of their hardship circumstance. The seller will have to show some utility bills and proof of occupancy. Mortgage statements, HOA statements, Fire Insurance and Tax bill. Signature on a 4506T form signed and Credit Authorization signed (they are going to check the taxes and every single thing).

The day you have collected your complete pile of papers and have an accurate dollar amount of everything past due you are ready to submit to the lenders. Most lenders loss mitigation departments have forms online ready for you to down load before you fax and paper overnight/ send the package. If I can tell you one vital tip it is this: HAVE EVERY SINGLE PIECE THE LENDER WANTS IN ONE PACKAGE UPFRONT. Make neat and have a contents cover page that reads simple and easy.

I have seen a number of strategies where Realtors/ agents only send for approval of the first lien holder then try to force the second and third to play ball. This can win if the other lien holders are related companies or if the losses are small. I have seen this fail every time the second is a credit union. It also creates additional delays and costs. Some lenders will only speak with the Seller, and you must have the Seller’s written authorization to speak with you on file (which the person on the phone will not locate and you will be ready to email it to them as you speak as an attachment. The glory of folders in email – label each one and be ready I say. Some lenders will accept the short sale package without a willing buyer/offer.

The pitfalls and the things to be aware of that a lender is not going to like:
Seller must be holder of title with no assignees. Also no assignees on purchase contract.
Lender may ask for 24 month chain of title and will review carefully if have been any LLC’, Corporations or any title transfers. These changes or having prior owners as company names are red flags. A family member or any related party can not be the buyer, this includes girlfriend boyfriend. Credit reports will show prior addresses and therefore reveals who knows who, among other cross references. Lenders may require two appraisals. This process takes time, i.e. appraisals become aged and have to be updated (this requires additional costs). It is important you are aware of comparable sales and market trends. Lender may restrict escrow/attorney and title fees. Lender will restrict commissions
Lender will check the relationship between the buyer and seller. Assume they will check everything and the seller and agents sign that items are truthful to the best of their knowledge.

Set up reasonable epectations of long time frames. It is easier to tell everyone a longer amount of time, and beat it.

Save the Birds in the Gulf BP

An oil spill that will murder mammals, birds and our economy thanks Tony Hayward.
Don't listen to Cramer, Short  BP.


I contacted BP to connect them with personal contact who is a volunteer (Pat Smith) and wild bird rescue expert at the Seabird Sanctuary in Tampa.  I suggested to the BP Emergency Team they get a news reporter to go interview her or the vet or ornithologists there. BP could post the instructions on their website. This center is run only by volunteers and is the largest in the Gulf. They do not have facilities large enough for a disaster such as this, but the public could help.


Information can be disseminated about how residents should collect the birds therefore the survival ratios will be higher. I imagine persons living in coastal communities in the Gulf could gather plastic baby pools and follow instructions to gather birds which will be covered in oil. Keeping the birds calm is the most important.


Shock and Stress kill wild birds. Some oiled birds will be sick from toxic effects of ingesting oil, or by exhaustion/starvation. It is important to keep the birds calm and not get deydrated. The bird should not be restrained or prevented from biting by binding its wings, legs, or beak. 
A diluted one percent solution of Dawn dishwashing liquid is used to remove oil, but the process of cleaning a wild bird can also kill the bird from the stress.

Dodd as Banking Reformer? Please Sell my Book.

America believed EVERYONE DESERVES to own a home.


Well not everyone is responsible in our country. Political tides pushed to make the products, models and rating systems to allow every GI who came home from Korea have a mortgage.
That was successful for a generation less greedy that worked hard, who believed in keeping their commitments. They only owed $20000. and had a $132.99 monthly payment.

The next “gimme” generation said “What about me? Where is my beautiful house?”

More shouted:.“This is prejudice, I deserve a house too.”

America gave them what they demanded, BUT they added a cost
to the risk. The individual who signed a subprime loan understood their credit is bad
or their house was funky.. They had to pay more because of their own flaws. The individual American was not bamboozled by Wall Street or a hooker hawking loans. That individual took a risk and believed they can flip a house and make a million dollars without any sweat or labor.

Yes, The banks profited from the growth. It got out of hand when a bartender got a job as a wholesale loan broker and took short cuts to make his million.

The secondary marketers could have checked the files, but some MBA and a Math Professor claimed their formula to cut out the person/monkey who worked for the bank with Moody’s ratings and FICO scoring would be manna from heaven.

Simon does not understand the business at the origination point.

A face to face application regulates a bevy of fraud. A real person  made accountable to make the
payment.A human banker would have to go knock on your door when you faced divorce death
or disaster and say: “Sir you need to sell.”

Goldman, Bear Stearns, Fannie, Freddie The Middle Man and The Banks - all made money on the trading as a commodity. They failed to open up a couple files and just check the bundle, check the white pages to see if the Borrower really lives in the house or see the self employed guy really had a business. They could have looked, but they were busy making a million.

Goldman was a genius team a year ago- knowing the bubble had burst they shorted us all.
They weren’t nakxd short, they just did what they always have- sell Americans what they
want, “ my own million without much effort.”

Senator Dodd’s bill fails to understand the center as well. Today Americans are going to

Protest in that southern point of New York. HOWEVER- Wall Street is not just there in New York.

Did we forget that Senator Dodd is in the "friends of Mozillo" club? Or Mr. Tangello as those outside of Countrywide might call him. Countrywide leads the nation in defaults and foreclosures today, how many loans did Dodd get? I remember.

Rick Perry Hunting Accident

 I love numbers.

A .380 Ruger with a crimson tree laser weighs 16 ounces + a holster 14 ounces.
That's a large gun to carry on a run. No runner on this earth would carry this gun.
If you are in fear of animal preditors; a shotgun is what you carry.
I'm a runner.  The edges of this gun would be clanking and getting in my way.
I'm a good shot. This is not a gun I would choose for snake hunting, Rick's story is
LIES.

Labrador retriever average weight 65-90 pounds. My sister's Back lab male was 120 all muscle with
the big square head- no coyote would have come out of the bushes. Average Lab height at shoulders 25".

Coyote weight 15-45 pounds and shoulder height 15"

Rick Perry is a big guy what ? 220 pounds?

I have faced three coyotes with a baseball bat, in the dark.
I am 5' 1" and tiny.
Think super vicious cocker-spaniel and Rick says it was one.
Yes coyotes can be hungry and sneaky and yes call them Western
legend evil...
Coyotes do what they must for food.
This is not an accident.
This is a macho guy making up an unauthenticated tale based on numbers
that do not add up.

Credit Repair Company Sued

Veracity credit repair is not the guys advertising on the radio that they can wipe out your debt with some
vague new law. On the side of credit card companies, Colorado Attorney General is sueing them for charging an upfront fee, and for misleading a consumer to believe they could "fix" their FICO score.
I have said this before, and we are not finished with the issue in the news but Goldman Sachs now knows that using a MIT Math model is not enough to insure the validity of a CDO.

"According to the complaint, filed in Denver County District Court, the credit-repair company is suspected of charging upfront fees for its services, which is illegal under state and federal law. The company, according to the complaint, required that consumers pay an initial setup fee of up to $99 and monthly fees of up to $79. Under Colorado law, a credit-repair firm can only charge fees once its services are complete.

Veracity also is alleged to have failed to disclose to its clients the total amount they would be charged for credit-repair services. The company also advertised that it could “optimize” consumers’ credit records by erasing or repairing bad credit. Under the federal Fair Credit Reporting Act and Colorado Consumer Credit Reporting Act, credit bureaus are allowed to report negative information about a consumer’s credit for seven years and information concerning bankruptcies for 10 years.



“Consumers trying to work their way out of debt and improve their credit should carefully examine the promises any credit-repair company makes,” Suthers said. “Consumers also should beware of any company that charges upfront fees for any credit-repair services. Upfront fees are prohibited under Colorado and federal law.”



Suthers said the Colorado Credit Services Organization Act and similar federal laws prohibit:

• Prohibit untrue or misleading statements and representations;

• Prohibit advance fees for services;

• Require disclosure of the total amount a consumer will have to pay for credit repair services;

• Require disclosure about when accurate information can be removed from credit reports;

• Require disclosure of a consumer’s right to correct inaccurate information; and,

• Providing consumers a five-day right to cancel a credit repair contract."

Capistrano School Board please step Down

The Board again played a trick on the teachers by cancelling the 10:00 meeting without notice.
My High school student at Dana Hills was corralled into a classroom by alphabetical order with 65 kids and 30 chairs. The room was so loud she could not study for her AP test. She couldn't even read. No learning  happened today. Students were released at 11:00 AM with no notice to parents

I have not heard from my middle school child as of this hour. The school bus service was uncertain if there would be buses today.

The Board made NO PLAN to educate students today, although they were aware the teachers might strike for weeks. The District’s website spouts tales about how credentialed substitute teachers would be teaching students in schools during the strike.

The District does not want parent help or input. The Board failed to respond to parents who emailed and wrote letters. The District demonstrates a pattern of avoiding public disclosure, holding secret meetings, and wasting taxpayer funds. The Board is playing a media relations fake to make parents and community angry at teachers..
A good General does not cut food rations and shoes for the front line soldiers while sitting in a cushy palace in San Juan Capistrano. The Taj Mahal palace cost $ 44 million dollars and bestows Board members, and District staff 1200 square foot palatial offices. The District has a history of mismanagement, disgrace and waste.


The District figured they could cut twelve million dollars by cutting teacher pay and slashing teacher benefits. It ‘appears’ they might like to fire higher paid teachers to rehire cheaper new ones in the negotiation techniques they have employed...

Half our State budget goes to “education.” Of that money more than 70% is allocated to administrators, brick and mortar, duplication of jobs, public relation firms, lawyers, special deals, and waste. Now the
District and Board have put taxpayers in a position to pay for the lawsuits, the special election and wasted learning hours that are the results of not settling in good faith.

100 Better Budget Repairs for Schools

It’s about money. Give me pragmatic solutions not pedagogic policy. Please take a minute to explain a problem or duplication and suggest a cheaper leaner better way in the comments box.


I am a Mom and a businesswoman. I am not running for office. We can save the right way. Cutting teacher salaries is not the correct path. We need concrete methods to reduce waste to bring to our Governor and State Board and Districts

Leave aside Unions and other elements of the education establishment. Be thick skinned. Allow those who are going to be hostile to input to open their hearts and make California education better.

Obama administration’s Race to the Top education improvement grants did nothing.

100 things in California’s education system which need to be made efficient:

First one: E.L. policies Assembly Bill 748 requires testing to measure ELD standards applied appropriately for students in each grade level. The Bill hoped to standardize English language arts content to ensure that limited-English proficient (LEP) students (now politically correctly renamed English learners in California) develop proficiency in English. The standards are supposed to assist teachers in moving English learners to fluency. The California English Language Development Test (CELDT) is a required state test for English language proficiency that must be given.


This is a behemoth of waste. The information gathering and testing forms change all the time. They are often outdated at the school site and expensive bar code forms tossed away. Some teachers might have 1 EL student a year and in another area they might have 12 or more. The teacher may score the student low on purpose in the start up to show improvement. There are special coordinators in each district. There are special employees to track the progress. Thousands of phone calls, hours of training. The teachers score a child on a scale that is vague and subjective. This is a paperwork monster. When the results finally return to the teacher so much time has gone by the teacher is already working with the child to get up to speed. The tools are broken.

I say to my children, “keep your eye on the ball, you have your studies and sports just block your ears to the drama and march on.”

I don’t want my children to loose faith in our system. They need to find solutions for their generation and I pray they just may be stronger than you and I...

I found myself choking up when I spoke to teachers yesterday morning standing in front of Niguel Hills Middle School with my sign. Yes I was on the picket line. I’m not a Teacher. I did cry later in my car. My sign isn’t about TRUSTees or RECALL its pragmatic and a plan. My white cardboard : SELL THE TAJ MAHAL. We as citizens not must tell all our Districts, all our representatives we have had enough.

A good General does not take away food and shoes from the soldier on the front line.

 The great State of California is near bankrupt. California is broken. We have pushed taxed, legislated away and restricted business so much they left. Hypomesus transpacificus (a little fish)  caused a new Dust Bowl in Central California. I know the Sacramento smelt is endangered but let's see the real picture. Now a number of other birds, animals, and fish will die because all the top soil is blowing away and the marsh lands are cracked bone dry.

Get real. Bureaucracy must be cut in size, dollar amount and endless legal foolishness. Citizens must be willing to volunteer and go without. I  tire of “special interest groups.” A vague phrase but it means someone thinks they are special and deserve a separate kingdom deal.

A few years ago I followed Dr. Fleming dropping off his grandchildren at Crown Valley (my son’s same school)

I asked our then Superintendant of Capistrano School District, “Why do we need such a large building for 250 employees?”

“Because they deserve a nice workplace.”

The word: DESERVE, it rang in my head like a marble in a goldfish bowl... or smelt bowl perhaps I ought to be farming them. The gesture with palm out, give me something great because I am entitled attitude.

   The old District offices (years later are still occupied by the District and never were sold or sublet i.e.: WASTE) weren’t in a gorgeous location. The buildings were adequate not great. The District offices had citronella eucalyptus trees that smelled of lemons  when the bows gently moved in the wind. The wash behind the structures was pretty in the spring with wildflowers and smooth stones . I run that path down to the beach. The buildings were older and industrial looking but at the time they were fine.

I am certain it is the same in every District. There is fat. The pay scale of a secretary starting at $ 67000.00 is wrong. The teacher on the front line start pay is much less. There is some secret revolving door in the District where a burn out is put in Administration

California has massive waste in the duplication of Districts. We have local city funded schools (the rich ones) and state funded schools (now the poor ones) and Charters and special interest ones also state funded and a and a. Eight hundred Districts need to merge into one hundred. Many administrators will be fired. It will be painful. I do not see a leader strong enough to get all the special interest whining out of the way and cut the blubber.

It is far easier for a District to cut the health benefits and pay of the soldier/the teacher on the front line.Weak leaders do it. I fear the teachers will not be able to make an impact with a three day strike. They can’t go long because they don’t have huge savings. Teachers are generally not the type to be aggressive and strategic. If the strike goes long the District will find a way to fire all the rabble rousers and hire cheaper new faces out of the what 15% unemployed in California

Maybe my sign should have said “Fired Teacher needs ten dollars?"

Commercial Building (Correction) Palace Half Price

I have two students in Capo District schools. I have numerous concerns about how the Board has handled negotiations and Now the District fails our children.



Allow me to go over a few ideas:

Our state is junk bond status.   All state funded school districts must cut

It makes NO sense to start at the first line of combat soldier and shoot him in the leg.

Teachers are the life line to educating, developing and leading our next generation to be great.

Teachers don't make a great deal of money and usually are in it for the vocation.

Cutting their pay is not going to balance the State wide shortfall of funds.



THE ONLY SENSIBLE SOLUTION IS:

Consolidate Districts- Centralize District offices

Lay off duplications in staff

Sell off half of the brick and mortar District offices in the state.

Put a sign on the Taj Mahal 33122 Valle Road

I know it cost more than forty two million to build but has excessive square footage for the

Number of employees who work there and a symbol of waste. Put a sign on the building for

$ 30,000,000. now and contact Saddleback and other local districts which are state funded

To start negotiations to combine with a contiguous district.



Capistrano Unified School District is the second largest school district in Orange County, California, the 12th largest in California and the 85th largest in the United States.
There are about 250 employees in the Valle building who make each more than $ 67000. and
a tiny smaller number of employees in Saddleback. All employees will be allowed to apply for the new combined district jobs without tenure and based on employment testing models, and job reviews that I pray you have completed. We don't need to hire a new superintendant- keep Steven Fish for 2011 at his same salary.



Cost savings so far $ 47 million



Legal fees, lawsuits, attorney fees, special education mediators, all the businesses that profit from taking away from students need to have caps on the costs. This is a much bigger issue which a District can not change, but can influence by holding the line and saying no to forking cash, aids and fix-its without looking at the whole.



Our population of students/ children is going to decline in the coming decade as there is no more
Open land for development. Our tax basis is going to continue to fall in the coming eight years as
Property tax revenues go down more, and more business leave the State.
Be nimble but -Don't put in junky mobile home classrooms which have a life of 5 years (after being tread on
by thousands of high school students these structures don't last and are wasteful).



Keep classrooms clean, free of vermin and safe.



There are four vacant District buildings that I am aware of, why have those not been sold?



Engage parents in volunteerism. Lead parents in fundraising that could target projects not just be
Put in a black hole. Ask parents to help you. My hand is raised asking what you need.



Get back to the bargaining table. The 2100 teachers and their families don't want a strike, but they deserve to be treated fairly in the workplace. I want my senior to be able to graduate. My younger child in Middle School needs to believe in a system that works together and creates solutions.

I pray you will find a different method.

School Districts Need to Centralize

Capistrano Teachers voted to strike. How this will play out, has yet to unfold.


Does the District have any plan to keep students learning?  
They plan to hire private security services ( at a huge cost) to corral high school
students into large groups and hope they will sit and read from their books.


Does the District have any realistic plans to cut their own bureaucracy?
Centralizing Districts is the only logical conclusion. Combined organizational structures, 
centralize procedures, sell and dispose of duplicate buildings and lead schools like a
business.

My City Manager sent me a letter asking that I provide input on meeting my existing and emerging needs. I assume he was unhappy about something I wrote in the Register regarding “The City Council has no fiscal responsibility and should stop all construction on the over budget, unnecessary palace and sell the land.” California faces junk bond status. Our City tax revenues are crashing. There are major budget cuts
for our teachers next it will be fire and police.

a Ford Mustang. I welcome all to have at it and drive that Ford down from Dawson City in Northern Canada.

In response to your lovely letter, I expect you to spend money as if it was being borrowed from your Grandmother who survived The Great Depression. We have now repaired the median on Golden Lantern with lush landscaping and new traffic design four times in three years, and the road appears about the same. We do need to pay our teachers, firemen, Sherriff the same salary they have become accustomed. I stand by my plan to join a Tri-City merger of all duplicated services.
